Competition Law & Loyalty Discounts

The European Union has well-established principles governing 'loyalty programs' and their potential for anti-competitive effect, especially when used by powerful suppliers. Until now, the US has been rather more relaxed on the nature and conditions associated with discounting and loyalty benefits. However, a recent Supreme Court decision suggests that businesses need to exercise greater caution. This article provides background and suggests the steps to take.
