Adjudication of construction disputes in Malaysia

Earlier this year, the Construction Industry Payment and Adjudication Act 2012 ('CIPAA') became effective, \r
introducing statutory adjudication as a means of resolving payment disputes under construction contracts for projects carried out in Malaysia. The provisions of the CIPAA will be relevant if you are involved at any level in a construction or engineering project wholly or partly being carried out in Malaysia. In addition to an adjudication regime, the CIPAA introduces default payment terms for construction contracts, stipulating the value and frequency of progress payments where such terms are not provided for under the contract, and prohibits the practice of including 'pay when paid' clauses
